A recent case in the U.S., involving two researchers charged with introducing mpox without declaration, highlights the importance of complying with biosafety regulations.

U.S. federal authorities have filed criminal charges against two researchers affiliated with the National Institutes of Health (NIH) for allegedly importing biological samples from the Republic of the Congo without authorisation.

The investigation found that the scientists had transported more than one hundred vials containing biological material, including samples related to the mpox virus, without properly declaring them to customs authorities. They initially stated that the samples were diagnostic materials.

While some of the samples contained inactivated virus and posed limited biological risk, the case primarily concerns non-compliance with the legal and procedural requirements associated with the international transport of biological substances.

The charges include conspiracy to illegally import biological material and making false statements, which may result in significant criminal penalties.

This incident highlights the importance of strengthening biosafety culture and individual responsibility in scientific research. Adherence to traceability, authorisation and declaration protocols is crucial to ensure the safety of personnel, the public and the environment, and to maintain public trust in research institutions.

The UAB Biosafety Committee therefore reminds all personnel of the importance of strictly adhering to current regulations at every stage of handling and transporting biological materials, including coordinating with the relevant authorities and obtaining the necessary authorisations.
