Article 37. Difusió en accés obert

Els agents públics del Sistema Espanyol de Ciència, Tecnologia i Innovació impulsen el desenvolupament de repositoris, propis o compartits, d’accés obert a les publicacions del seu personal de recerca, i estableixen sistemes que permetin connectar-los amb iniciatives similars d’àmbit nacional i internacional.
El personal de recerca l’activitat investigadora del qual estigui finançada majoritàriament amb fons dels pressupostos generals de l’Estat fa pública una versió digital de la versió final dels continguts que li hagin estat acceptats per a publicació en publicacions de recerca seriades o periòdiques, tan aviat com sigui possible, però com a molt tard dotze mesos després de la data oficial de publicació.
La versió electrònica es fa pública en repositoris d’accés obert reconeguts en el camp de coneixement on s’ha dut a terme la recerca, o en repositoris institucionals d’accés obert.
La versió electrònica pública la poden fer servir les administracions públiques en els seus processos d’avaluació.
El Ministeri de Ciència i Innovació ha de facilitar l’accés centralitzat als repositoris, i la seva connexió amb iniciatives similars nacionals i internacionals.
Això s’entén sense perjudici dels acords en virtut dels quals s’hagin pogut atribuir o transferir a tercers els drets sobre les publicacions, i no és aplicable quan els drets sobre els resultats de l’activitat de recerca, desenvolupament i innovació siguin susceptibles de protecció.

Objectius I i II de la Política institucional d'accés obert de la Universitat Autònoma de Barcelona, aprovada pel Consell de Govern el 25 d’abril de 2012, acord 46/2012:

El personal docent i investigador (PDI) de la Universitat Autònoma de Barcelona dipositarà les seves publicacions acadèmiques i científiques (articles de revista, tesis, ponències, comunicacions, documents científicotècnics, llibres, etc.) en el Dipòsit Digital de Documents de la UAB (DDD), http://ddd.uab.cat. Es tindran en compte, si s’escau, les condicions establertes per les editorials en relació amb l'arxiu de documents en dipòsits digitals d'accés obert. Si aquestes condicions no permeten l’accés lliure a la publicació completa, aquesta s’hi inclourà de forma restringida i només es permetrà l’accés al resum o a les metadades completes que la descriuen, segons sigui possible en cada cas. L'arxiu dels documents es persegueix que pugui dur-se a terme tot just després de la publicació i en qualsevol cas en un termini no superior als sis mesos.
Pel que fa als recursos educatius, la Universitat Autònoma de Barcelona, encoratja al personal docent a dipositar aquests continguts en el dipòsit digital. De forma complementària, la Universitat recomana a la comunitat acadèmica la publicació, quan sigui possible, en revistes d'accés obert.

En cas de gaudir d’un ajut de recerca, addicionalment cal comprovar les recomanacions en matèria d’Accés Obert especificades per l’Agència Finançadora.

Annex 5: Specific rules del General Model Grant Agreement del Programa Horizon Europe: Communication, Dissemination, Open Science and Visibility (Article 17)

Open Science: Open access to scientific publications
The beneficiaries must ensure open access to peer-reviewed scientific publications relating to their results. In particular, they must ensure that:

at the latest at the time of publication, a machine-readable electronic copy of the published version, or the final peer-reviewed manuscript accepted for publication, is deposited in a trusted repository for scientific publications
immediate open access is provided to the deposited publication via the repository, under the latest available version of the Creative Commons Attribution International Public Licence (CC BY) or a licence with equivalent rights; for monographs and other long-text formats, the licence may exclude commercial uses and derivative works (e.g. CC BY-NC, CC BY-ND) and
information is given via the repository about any research output or any other tools and instruments needed to validate the conclusions of the scientific publication.

Beneficiaries (or authors) must retain sufficient intellectual property rights to comply with the open access requirements.
Metadata of deposited publications must be open under a Creative Common Public Domain Dedication (CC 0) or equivalent, in line with the FAIR principles (in particular machineactionable) and provide information at least about the following: publication (author(s), title, date of publication, publication venue); Horizon Europe or Euratom funding; grant project name, acronym and number; licensing terms; persistent identifiers for the publication, the authors involved in the action and, if possible, for their organisations and the grant. Where applicable, the metadata must include persistent identifiers for any research output or any other tools and instruments needed to validate the conclusions of the publication.
Only publication fees in full open access venues for peer-reviewed scientific publications are eligible for reimbursement.

Article 29.2 de l'Annotated Model Grant Agreement del Programa Horizon 2020: 29.2. Open access to scientific publications

Each beneficiary must ensure open access (free of charge, online access for any user) to all peer-reviewed scientific publications relating to its results.
In particular, it must:

(a) as soon as possible and at the latest on publication, deposit a machine-readable electronic copy of the published version or final peer-reviewed manuscript accepted for publication in a repository for scientific publications;
(b) ensure open access to the deposited publication — via the repository — at the latest:. Moreover, the beneficiary must aim to deposit at the same time the research data needed to validate the results presented in the deposited scientific publications.
- (i) on publication, if an electronic version is available for free via the publisher, or
- (ii) within six months of publication (twelve months for publications in the social sciences and humanities) in any other case.
(c) ensure open access — via the repository — to the bibliographic metadata that identify the deposited publication.

The bibliographic metadata must be in a standard format and must include all of the following:

the terms [‘European Union (EU)’ and ‘Horizon 2020’][‘Euratom’ and Euratom research and training programme 2014-2018’];
the name of the action, acronym and grant number;
the publication date, and length of embargo period if applicable, and
a persistent identifier.
