Intellectual Property Legislation is increasingly essential knowledge for the legal development of many activities and professions — not only to avoid infringing on others’ rights, but also to protect one’s own creations. The digital world has made it easier to create and share content, but at the same time, it has also increased the risk of copyright infringement.

In this course, students will gain the theoretical and practical foundation necessary to understand and apply the Revised Text of the Intellectual Property Law, approved by Royal Legislative Decree 1/1996, of April 12. This course also explains the difference between intellectual property law (which concerns intangible creations such as literary and artistic works) and patent law (which protects technical inventions and original industrial processes).

Objectives:
- Understand the theoretical foundations of intellectual property rights.
- Apply the theoretical framework and legal criteria of intellectual property rights.
- Identify the exceptions to intellectual property rights.
- Understand the special regimes within intellectual property law.
- Learn about related (neighboring) rights.

Curriculum:

Module 1. Foundations of the Intellectual Property Regime
- The concept of a “work” and the involved parties. Differences with patent protection.
- Moral rights.
- Practical examples of moral rights.
- Economic (exploitation) rights.
- Practical examples of exploitation rights.

Module 2. Protection of Intellectual Property
- Limitations and exceptions to protection.
- The transfer regime of rights and infringements.

Module 3. Special Intellectual Property Regimes

- Audiovisual works, computer programs, databases, and GPL licenses.
- Artificial intelligence and intellectual property protection.

Module 4. Related Rights

- Production of phonograms and audiovisual recordings, publishing rights, broadcasting entities.
- Artistic performances andmere photographs.
